Reinitiation of Consultation or Permit Amendment. The Parties recognize and agree that a change to a component of the Action subject to adaptive management as described in this Agreement may require reinitiation of consultation under the ESA or an amendment to the Permit issued for the Action. The Parties agree that any decision on the operational criteria will be based on the best scientific and commercial data available at that time, including data collected and analysis conducted through the Adaptive Management Program pursuant to this Agreement. If those data and analyses indicate that one or more of the water operations flow criteria in the Biological Opinions or Permits should be changed, Reclamation will, if required, reinitiate consultation pursuant to Section 7 of the ESA and/or DWR will, if required, commence a permit amendment process under California law to modify the operating criteria, as appropriate.

  • TERMINATION OR AMENDMENT The Committee may terminate or amend the Plan or this Agreement at any time; provided, however, that no such termination or amendment may adversely affect the Participant’s rights under this Agreement without the consent of the Participant unless such termination or amendment is necessary to comply with applicable law or government regulation. No amendment or addition to this Agreement shall be effective unless in writing.

  • Modification or Amendment Subject to the provisions of the applicable Laws, at any time prior to the Effective Time, the parties hereto may modify or amend this Agreement, by written agreement executed and delivered by duly authorized officers of the respective parties.

  • Duration of Consent Customer consent to receive electronic delivery of Customer Account Documents will be effective immediately and will remain in effect unless and until either the Customer or the Broker revokes it.   • Revocation of Consent Subject to the terms of this Customer Agreement, the Customer may revoke or restrict consent to electronic delivery of Account Documents at any time by notifying the Broker in writing of the intention to do so. The Customer also understands that the Customer has the right to request paper delivery of any Customer Account Document that the law requires the Broker to provide to the Customer in paper form. The Broker will not treat the Customer request for paper copies as a withdrawal of consent to electronic delivery of Customer Account Documents. The Customer understands that if revoking or restricting consent to electronic delivery or requesting paper delivery of Customer Account Documents, the Broker, in its sole discretion, may charge the Customer a reasonable service fee for the delivery of any Customer Account Documents that would otherwise be delivered to the Customer electronically, restrict or close the Customer Account, or terminate the Customer’s access to the Broker’s services. The Customer understands that neither the revocation or restriction of consent, nor the request for paper delivery, nor the Broker’s delivery of paper copies of Customer Account Documents will affect the legal effectiveness or validity of any electronic communication provided while consent was in effect.

  • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter.
