Common use of REIT Documents Clause in Contracts

REIT Documents. The REIT shall have executed and delivered to Agent each of the following, in form and substance acceptable to Agent and Agent's counsel: (i) The REIT Guaranty; (ii) A solvency certificate; (iii) A Compliance Certificate confirming the matters described in Section 4.01(i); and (iv) All other documents to be executed by or on behalf of the REIT as listed on the Closing Checklist.

The REIT shall have executed and delivered to Agent each of the following, in form and substance reasonably acceptable to Agent and Agent's counsel: (i) This Agreement; (ii) The REIT Guaranty; (iiiii) A solvency certificate;; and (iiiiv) A Compliance Certificate compliance certificate confirming the matters described in Section 4.01(i4.02(h); and (iv) All other documents to be executed by or on behalf of the REIT as listed on the Closing Checklist.
