Common use of Rejected Project Genes Clause in Contracts

Rejected Project Genes. Any Project Gene the Protein product of which has not been designated as a Protein Candidate pursuant to subsection (b) above, shall be deemed a Rejected Project Gene for purposes of this Agreement. Genentech shall have the rights and obligations set forth in Articles 5 and 6 with regard to such Rejected Project Genes.

Rejected Project Genes. Any Project Gene the Protein product of which has not been designated as a Protein Candidate pursuant to subsection (b) abovethis Section 3.5, shall be deemed a Rejected Project Gene for purposes of this Agreement, unless and until such Rejected Project Gene has been designated a Genentech Advanced Research Protein Candidate or a Lexicon Advanced Research Protein Candidate pursuant to Section 3.7. Genentech shall have the rights and obligations set forth in Articles 5 Article 6: and 6 Article 7: with regard to such Rejected Project Genes.
