(b) The Company acknowledges that it is familiar with Section 1542 of the California Civil Code, which reads as follows: A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor. The Company acknowledges and agrees that it is releasing unknown claims and waives all rights that it may have under Civil Code Section 1542 or under any federalother statute or common law principle of similar effect.
(c) The Company represents and warrants that it has not filed any complaints or charges asserting any Company Claims against the Bermxx Xxxeasees with any local, state or local lawfederal agency or court. The Company further represents and warrants that it has not assigned or transferred to any person or entity any Company Claims or any part or portion thereof.
(d) The Company agrees that it will not hereafter pursue any Company Claims against any Bermxx Xxxeasee by filing a lawsuit in any local, and state or federal court for or on account of any other known anything which has occurred up to the present time as a result of your employment or unknown claims in contract, tort or common law, including, but not limited to, actions for libel, slander, defamation or small claims accruing through the date termination of its signing of this Agreementemployment; provided, however, that nothing in this waiver does not apply Section 4 shall be deemed to release you from any claims the Company may have (i) under this Agreement, or rights that accrue after (ii) for breaches prior to the date hereof of the Company signs this nondisclosure provisions of Section 6 of the Employment Agreement or claims Annex B to enforce the terms of this Agreement brought by the CompanyEmployment Agreement.

Nothing in this Agreement prevents the Company from filing a charge or complaint with the Equal Employment Opportunity Commission, howeverthe National Labor Relations Board, that this waiver the Occupational Safety and Health Administration, the Securities and Exchange Commission or any other federal, state or local governmental agency or commission (collectively, the “Government Agencies”). This Agreement does not apply to claims or rights that accrue after the date the Company signs this Agreement or claims to enforce the terms of this Agreement brought by limit the Company’s ability to communicate with any Government Agencies or otherwise participate in any investigation or proceeding that may be conducted by any Government Agency, including providing documents or other information, without notice to you.
