Remedies for Breach of Certain Sections. (i) Notwithstanding any other provision of this Agreement or any other agreement or document to the contrary, this Section 10(c) sets forth certain remedies of the Company and liability of the Executive with respect to any breach by the Executive of certain provisions of this Agreement based upon the Parties’ reasonable estimates of the damage that would be suffered by the Company in the event of such a breach by the Executive. The Parties hereto agree that the remedies of the Company pursuant to this Section 10(c) are not intended as a penalty and are in addition to all other remedies and rights available to the Company in respect of such breach.

The Parties hereto agree that the remedies of the Company pursuant to this Section 10(c11(c) are not intended as a penalty and are in addition to all other remedies and rights available to the Company in respect of such breach.
