Common use of Remedies for Non-Compliance Clause in Contracts

Remedies for Non-Compliance. If JFS commits an Event of Default or fails in any way to comply with Federal or state statutes, local laws or regulations, or the terms and conditions of this Agreement, the City may impose additional conditions as described in 2 CFR §200.207. If the City determines that noncompliance cannot be remedied by imposing additional conditions, the City may take one or more of the following actions, including but not limited to: (a) Temporarily withhold cash payment pending correction of the deficiency or more severe enforcement action by the City; (b) Disallow both use of funds and any applicable matching credit for all or part of the cost of the activity or action not in compliance; (c) Wholly or partly suspend or terminate the award; (d) Initiate suspension or debarment proceedings as authorized under 2 CFR part 180 and applicable regulations or recommend such proceedings be initiated by HUD; (e) Withhold further federal awards for the project or program; or (f) Take other remedies that may be legally available including, but not limited to litigation, declaratory judgment, specific performance, damages, injunctions, termination of the Agreement, or any other available remedies.
