Common use of Remedies Vested in Trustee Clause in Contracts

Remedies Vested in Trustee. All rights of action, including the right to file proof of claims under this Indenture or under any of the Notes may be enforced by the Trustee without the possession of any of the Notes or the production thereof in any trial or other proceedings relating thereto, and any such suit or proceeding instituted by the Trustee shall be brought in its name as Trustee without the necessity of joining as plaintiffs or defendants any Beneficiaries, and any recovery of judgment shall be for the equal benefit of all Beneficiaries in respect of which such judgment has been recovered.

All rights of action, action including the right to file proof of claims under this Indenture Agreement or under any of the Notes Outstanding Obligations may be enforced by the Trustee without the possession of any of the Notes Outstanding Obligations or the production thereof in any trial or other proceedings relating thereto, thereto and any such suit or proceeding instituted by the Trustee shall be brought in its name as Trustee without the necessity of joining as plaintiffs or defendants any Beneficiariesholders of the Outstanding Obligations, and any recovery of judgment shall be for the equal benefit of all Beneficiaries in respect the holders of which such judgment has been recoveredthe Outstanding Obligations.
