Remote Deposit Capture Services. We may provide Remote Deposit Capture Services to you during the Term of this Agreement. We may establish certain criteria that customers are required to meet prior to being permitted to use Remote Deposit Capture Services, and we reserve the right to prohibit any person from using Remote Deposit Capture Services in our sole and absolute discretion. As used in this Section, “images” means electronic image and data files submitted by you to us in connection with the Remote Deposit Capture Services. Through our Remote Deposit Capture Services, we may allow you to transmit images to us for us to process for payment through the Federal Reserve System or other clearing networks and depositing into a Customer Account. We may prepare image replacement documents to facilitate the deposit and collection of items. You will be responsible for the accurate scanning of checks and for successfully transmitting accurate, complete, balanced, and readable images to us. You shall cause the image quality of each check image provided by you to satisfy the requirements of Applicable Law. You shall cause each check to be properly endorsed by all required persons prior to conversion of the check into a File. You shall not transmit check images to us that contain information which duplicates information you previously provided to us or that contains information with respect to checks that you have previously transferred to, deposited with, or attempted to clear through a third party. You shall not transfer to, deposit with, or attempt to clear through a third party or otherwise directly or indirectly ask any third party to make payment based on, the checks reflected in the check images transmitted to us. You shall ensure that the images accurately represent all of the information on the front and back of checks, including all endorsements. You shall maintain any original checks for which an image has been sent to us in a secure environment and shall destroy the original checks within thirty (30) days after successful transmission to us (unless doing so would be a violation of Applicable Law). You will be solely responsible for any liability resulting from further negotiation or transfer of any checks for which a check image has been submitted to us. Remote Deposit Capture Services. Remote Deposit Capture Service allows you to remotely deposit paper checks from your mobile device to your Credit Union account by electronically transmitting a digital image of the paper check to the Credit Union. SYSTEM REQUIREMENTS To use this Service, you must meet the following criteria: • You must have a smart phone with an embedded camera and service plan that includes data and internet access. Third party fees may apply for data and Internet access. Contact your smart phone device carrier for additional information. • You must have the Westmark Credit Union Application installed on your smart phone device. The Westmark Mobile Application can be downloaded from your device’s application store. The Operating System version must be compatible with the latest version of the application as determined by your device’s application store. • You must be enrolled in the Mobile Banking Service. • Must have an active Westmark Checking Account in order to use Mobile Check Deposit
Remote Deposit Capture Services. Through the Bank’s Remote Deposit Capture Services, the Company may, from time to time, capture an electronic image of a check and transmit that image to the Bank over the internet through a web-based interface for deposit to a Company Account (the “RDC Services”). To be eligible to enroll in and use the RDC Services, the Company must be approved by the Bank. The Company agrees to provide the Bank with such financial, business and operating information as the Bank may reasonably request in connection with the Bank’s approval process. If approved, the Company shall be responsible, at the Company’s sole cost and expense, for acquiring and installing any hardware, including, but not limited to, a personal computer and an image scanner (the “Equipment”) required to access the RDC Services. The Company must use Equipment that meets the Bank’s technical requirements. The Company acknowledges and agrees that it is solely responsible, at the Company’s cost and expense, for the use, operation, performance and maintenance of all Equipment. The Company further acknowledges and agrees that it will perform or cause to be performed all vendor recommended maintenance, repairs, upgrades and replacements by properly trained personnel. The Bank shall not be liable to the Company for any malfunction, non-function, inaccuracy or other failure of the Equipment used by the Company to access the RDC Services, regardless of whether the Bank approved such equipment. The Company agrees to use the Equipment in a manner consistent with the terms of this Agreement and for no other purpose. The Company shall be responsible for installing and implementing any changes and upgrades to the Equipment that may be required by the Bank within five (5) days of notification thereof to ensure compliance with regulatory changes or developments, or to protect the integrity and security of the RDC Services. The Company shall be responsible for training its own employees on how to use the Equipment and RDC Services. The Company agrees that it will only submit checks for processing through the RDC Services that meet the definition of a “check” set forth in Federal Reserve Board Regulation CC, as amended from time to time (“Regulation CC”). The Company further agrees that it shall not process any Non-Qualifying Items through the RDC Services. Remote Deposit Capture Services may be designated by us on the Web Site or in other communications or services as "XpressDeposit" or "Xpress Deposit" services. We may establish certain criteria that customers are required to meet prior to being permitted to use Remote Deposit Capture Services, and we reserve the right to prohibit any Person from using Remote Deposit Capture Services in our sole and absolute discretion. As used in this Section, "Files" means electronic image and data files regarding checks to be deposited, which image and data files are submitted by you to us in connection with the Remote Deposit Capture Services. Through our Remote Deposit Capture Services, we may allow you to transmit Files to us for us to process for payment through the Federal Reserve System or other clearing networks and depositing into a Customer Account or, if we allow in our sole and absolute discretion, an account other than a Customer Account. We may prepare image replacement documents to facilitate the deposit and collection of items. You will be responsible for the accurate scanning of checks and for successfully transmitting accurate, complete, balanced, and readable Files to us. You will be required to create Files using a XXXXX compliant scanner or other Required Technology, as we determine from time to time. You shall cause the image quality of each File provided by you to satisfy the requirements of Applicable Law. You shall cause each check to be properly endorsed by all required Persons prior to conversion of the check into a File. You shall place an "electronically presented" legend and such other information required by us on the rear of each check immediately after each check shall be scanned. See the Section titled "Mobile Banking Services” for endorsement requirements regarding the Mobile Remote Deposit Capture (mRDC) functionality with respect to certain Signature2Go Mobility Apps. You shall ensure that the Files accurately represent all of the information on the front and back of checks, including all endorsements. Remote Deposit Capture Services. We may provide you with the ability to make deposits to your Account from a home, office or other remote location using a compatible mobile device (camera), computer hardware (scanner), software or web-based application (individually and collectively, the “Device”) by creating an image, preparing an electronic picture or replica of the front and back of an Eligible Item and deliver such image, picture or replica (the “Image”) and associated deposit information to us (the “Remote Deposit Capture Services”). “Eligible Items” are checks or other paper items (not a prohibited item under this Section X (A) (Remote Deposit Capture Services) or item rejected by us), payable on demand and drawn on (or payable through) an office of a United States bank, to be converted to Images and deposited into your Account using the Remote Deposit Capture Services.
Remote Deposit Capture Services. 17.1 INTRODUCTION. This Service Agreement contains terms and conditions specifically applicable to our Remote Deposit Capture (RDC) services, formerly referred to as Remote Image Deposit (“RDC Service”). In using the RDC Service, you agree to be bound by this Service Agreement, the TMS General Terms and Conditions (“TMS General Terms”) and the applicable User Guides.
Remote Deposit Capture Services. The Remote Deposit Capture (“RDC”) Service allows you to make deposits to your deposit accounts listed in the Cash Management Application and Enrollment Form or Cash Management Amendment Form and made a part hereof (each such deposit account an “Account” and, collectively, the “Accounts”) from your office by scanning checks on a desktop scanner and delivering the images and information required hereby to us or our designated processor (a “Processor”). The terms Bank, Us, We, Our, and Processor may be used interchangeably when used in relation to any services performed by a Processor on behalf of us including, but not limited to, the receipt and processing of images and check data and any notices related thereto. The scanner must capture an image of the front and back of each Check (as herein defined) to be deposited (each an “Image” and, if more than one, “Images”) in accordance with the Procedures (as herein defined), must read and capture the magnetic ink character recognition (“MICR”) line on each check and must read and capture all such other data and information as is required by this Agreement. After capture of the Images, the MICR line on each check and all other required data and information from each check, you will transmit one or more files containing the Images, the MICR line from each check and all other required data and information from or pertaining to all checks and all batched ACH (as herein defined) data and other required information (each such file a “File” and, if more than one, “Files”) to us or Processor via the Internet. Subject to compliance with the terms, provisions and conditions of, and as provided in, this Agreement, we will provisionally credit the Account or Accounts designated by you for the amount of the deposit(s) to which the File(s) pertains on the day of receipt of the File(s) and enter the images of the checks into the collection process, in accordance with the provisions of our then current deposit account agreement and disclosure pertaining to the Account(s) into which the deposit is to be made (the “Deposit Agreement”) and this Agreement. In addition, or as an alternative to transmitting images of checks, you may use the desktop scanner to initiate electronic signals for paperless debit entries through us to accounts maintained either by us or in other depository financial institutions by means of the Automated Clearing House (“ACH”). Remote Deposit Capture Services. Remote Deposit Capture Services (“Remote Deposit Services”) allow you to remotely deposit paper checks you receive to your account with us, by electronically transmitting a digital image of valid paper checks to us for deposit (“Check” or “Item”). The digital image of the Item (front and back) and other information must be electronically transmitted to us or designated processor for deposit and is available for eligible members and qualified accounts after you have enrolled in the Remote Deposit Services.

  • Acupuncture Services Benefits will be provided for Medically Necessary acupuncture services when provided by a provider licensed to perform such services.

  • Future Services The Consultant acknowledges each of the following with regard to performing future services for the City: • The Consultant’s performance of the services required by this Agreement may create an actual or appearance of a conflict of interest with regard to the Consultant performing or participating in the performance of some related future services, particularly if the services required by this Agreement comprise one element or aspect of a multi-phase process or project; • Such an actual or appearance of a conflict of interest would be a ground for the City to disqualify the Consultant from performing or participating in the performance of such future services; and • The Consultant is solely responsible for considering what potential conflicts of interest, if any, performing the services required by this Agreement might have on its ability to obtain contracts to perform future services.

  • Core Services The Company agrees to provide to the Municipality the Core Services set forth in Schedule “A”. The Company and the Municipality may amend Schedule “A” from time to time upon mutual agreement.

  • Mobile Banking Service Mobile Banking is offered as a convenience and supplemental service to our Online Banking services. It is not intended to replace access to Online Banking from your personal computer or other methods you use for managing your accounts and services with us. Mobile Banking allows you to access your Patriot account information, use bill pay, transfer funds between your accounts, deposit items remotely and conduct other banking transactions. We reserve the right to limit the types and number of accounts eligible and the right to refuse to make any transaction you request through Mobile Banking. We may also reserve the right to modify the scope of the Mobile Banking Service at any time. Mobile Banking may not be accessible over some network carriers. In addition, the Mobile Banking Service may not be supportable for all Devices. Patriot cannot guarantee, and is not responsible for, the availability of data services provided by your mobile carrier, such as (but not limited to) data outages or "out of range" issues. You agree to accept responsibility for learning how to use Mobile Banking in accordance with the instructions and agree that you will contact us directly if you have any problems with Mobile Banking. We may modify the Mobile Banking Service from time to time at our sole discretion. You are responsible for making sure you understand how to use Mobile Banking as modified. You also accept responsibility for making sure that you know how to properly use your Device and we will not be liable to you for any losses caused by your failure to properly use the Mobile Banking Service or your Device. You agree that, when you use Mobile Banking, you remain subject to the terms and conditions of your existing agreements with any unaffiliated service providers, including, but not limited to, your mobile service provider and that this Agreement does not amend or supersede any of those agreements. You understand that those agreements may include fees, limitations and restrictions which might impact your use of Mobile Banking (such as data usage or text messaging charges imposed on you by your mobile service provider for uses of or interaction with Mobile Banking), you agree to be solely responsible for all such fees, limitations, and restrictions. You agree that only your mobile service provider is responsible for its products and services. Accordingly, you agree to resolve any problems with your provider directly without involving us. Any deposit account, loan or other credit union product accessed through this Mobile Banking service is also subject to the Account Agreements and Disclosures provided at time of account opening. You should review the Account disclosures carefully, as they may include transaction limitations and fees which might apply to your use of Mobile Banking.
