Common use of Removal of Subcontractor or Subcontractor's Personnel Clause in Contracts

Removal of Subcontractor or Subcontractor's Personnel. The Owner has the right at any time to request removal of a Subcontractor and/or any of a Subcontractor's personnel from Work on the System upon reasonable grounds and reasonable prior notice to Vendor. Such request (a "Request for Removal") shall be in writing and shall specify the Owner's reasoning therefor. The Vendor promptly shall issue a written response to any such Request for Removal, specifying the reasoning for its disagreement or agreement, as the case may be, with the reasoning contained in the Request for Removal. If the parties fail to agree, this matter shall be handled in accordance with the dispute resolution procedures in Section 23. The exercise of such right by the Owner shall have no effect on the provisions of subsections 4.1 and 4.2.
