Common use of Renegotiation of Prepaid Capitation Rates Clause in Contracts

Renegotiation of Prepaid Capitation Rates. The prepaid capitation rates for Recipients enrolled in the MCO shall be subject to renegotiation not more than annually unless required by state or federal law or regulation, or necessary due to changes in eligibility and/or benefits. Renegotiated rates will require CMS approval according to section 4.3.
