Common use of Rent Control Clause in Contracts

Rent Control. If the annual base rental or any additional rent shall be or become uncollectible, reduced or required to be refunded by virtue of any law, governmental order or regulation, or direction of any public officer or body pursuant to law, Tenant shall within ten (10) days of request enter into an agreement or agreements and take such other action as Owner may request, as may be legally permissible, to permit Owner to collect the maximum annual base rent and additional rent which may from time to time during the continuance of such rent restriction be legally permissible, but not in excess of the amounts of annual base rent or additional rent payable under this Lease. Upon the termination of such rent restriction prior to the termination of the term of this Lease, (a) the annual base rent and additional rent, after such termination, shall become payable under this Lease in the amount of the annual base rent and additional rent set forth in this Lease for the period following such termination, and (b) Tenant shall pay to Owner, to the maximum extent legally permissible, an amount equal to (i) the annual base rent and additional rent which would have been paid pursuant to this Lease but for such rent restriction less (ii) the annual base rent and additional rent paid by Tenant to Owner during the period that such rent restriction was in effect. This provision shall survive the expiration or earlier termination of this Lease to the maximum enforceable extent.

Rent Control. If at the annual base rental commencement of, or at any additional rent time(s) during the term of this lease, the rent(s) reserved in this lease shall not be or become uncollectible, reduced or required to be refunded by virtue fully collectible for reason of any Federal, State, County or City law, governmental proclamation, order or regulation, or direction of any a public officer or body pursuant to law, Tenant shall within ten (10) days of request enter into an agreement or agreements such agreement(s) and take such other action steps (without additional expense to Tenant) as Owner may request, request and as may be legally permissible, permissible to permit Owner to collect the maximum annual base rent and additional rent rents which may from time to time during the continuance of such legal rent restriction be legally permissible, but permissible (and not in excess of the amounts of annual base rent or additional rent payable reserved therefor under this Leaselease). Upon the termination of such legal rent restriction prior to the termination expiration of the term of this Leaselease, (a) the annual base rent and additional rent, after such termination, rents shall become and thereafter be payable under this Lease hereunder in accordance with the amount of the annual base rent and additional rent set forth amounts reserved in this Lease lease for the period periods following such termination, and (b) Tenant shall pay to Owner, to the maximum extent if legally permissible, an amount equal to (i) the annual base rent and additional rent rents which would have been paid pursuant to this Lease lease but for such legal rent restriction restriction, less (ii) the annual base rent and additional rent rents paid by Tenant to Owner during the period that period(s) such legal rent restriction was in effect.
