RESPECT. All employees will be treated with respect by supervisors, managers and other employees of the Employer. Bullying will not be tolerated. The Employer will follow a formal complaint process, investigate complaints submitted in accordance with the policy, and take action it determines is appropriate to ensure compliance with this article. If any of the following occur, an employee may file a grievance at Step 2: The Employer fails to investigate, make findings and take such action as it deems appropriate within thirty (30) days of the filing of the complaint (such timeline may be extended by mutual agreement based on the circumstances of the investigation); the Employer finds that the complaint is not substantiated; or the Employer’s action does not result in a cessation of conduct in violation of this article. In the case of an arbitration over whether or not a complaint is substantiated, the Arbitrator’s authority is limited to finding that the complaint should have been substantiated and directing the Employer to take action it determines is appropriate to ensure compliance with this article.
