Common use of Repair, Replacement or Rework Clause in Contracts

Repair, Replacement or Rework. As to each matter covered by this Warranty BRAD's sole obligation and liability under this Warranty is expressly limited to, at BRAD's election, correction by the repair, replacement or rework of the defective part or item of Technical Data. The repaired, replaced or reworked part or item of Technical Data which is the subject of the Warranty claim shall then be warranted under the same terms and conditions for the then unexpired portion of the Warranty Period. In the case of a Defect relating to non-conformance with the Specification, BXXX shall correct that Defect in the equipment item or part in which the Defect appears, except that BXXX will not be obligated to correct any Defect which has no material adverse effect on the maintenance, use or operation of the Aircraft or the image of Buyer as a reputable airline operator.
