Common use of Replacement by Arbitration Clause in Contracts

Replacement by Arbitration. (a) If the parties are unable to reach agreement on replacement provisions pursuant to section 25.1, any of them may refer the issues in dispute to arbitration in accordance with this section 25.2. (b) If any party makes a referral to arbitration under this section 25.2, the parties will agree upon a single arbitrator within fifteen days of the date of the referral. If such agreement is not reached any of them may ask the Chief Justice of the Supreme Court of British Columbia to make the appointment and the person so appointed will be the arbitrator. (c) The arbitration will be conducted in accordance with the Commercial Arbitration Act, using the Rules of the British Columbia International Arbitration Centre for the Conduct of Domestic Commercial Arbitrations, except to the extent such rules are modified by this Agreement or any other agreement between the Government and the BCMA. (d) Subject to section 25.3, the arbitrator will issue a final and binding award on all of the outstanding issues.
