Common use of Replacement of Rejected Product Clause in Contracts

Replacement of Rejected Product. As to any Rejected Product pursuant to paragraph 2.7(a) above (including phases of or complete batches of bulk product), DPT shall replace such Rejected Product (in an agreed upon batch order quantity, but in no event less than full batch increments) promptly after all materials are available to DPT for the manufacture. If requested, DPT shall make arrangements with COMPANY for the return or disposal of Rejected Product.

Replacement of Rejected Product. As At the COMPANY’s option, as to any Rejected Product pursuant to paragraph 2.7(a) above (including phases of or complete batches of bulk product), DPT shall replace such Rejected Product (in an agreed upon batch order quantity, but in no event less than full batch increments) promptly after all materials are available to DPT for the manufacture. As to any Rejected Product agreed by the Parties as failing to meet the Specifications or determined by the Laboratory not to meet the Specifications, pursuant to paragraph 2.7(a) above Section 4.4.4 below (including in each case phases of or complete batches of bulk productProduct), DPT shall replace such Rejected Product (in an agreed upon batch order quantity, but in no event less than full batch increments) promptly after all requisite materials are available to DPT for the manufacturemanufacture of replacement Product. If requested, DPT shall make arrangements with COMPANY for the return or disposal of Rejected Product.

If requested, DPT shall make arrangements manufacture of replacement Product with COMPANY for the return or disposal of Rejected Productcosts allocated pursuant to Section 4.4.3 below.
