Common use of Replacement/Repair Policy Clause in Contracts

Replacement/Repair Policy. Your new Device may be replaced or repaired only under the following terms and conditions: (1) Device may be replaced if it is within its warranty period and has been determined by GTA to be defective and not repairable. (2) If Device is within its warranty period and has been determined to be repairable by GTA: (i) you may approve the repair and you will be provided a loaner Device at no cost, or (ii) you may decline the repair and your Device will be returned to you as-is. (3) Determination of whether the Device is defective or repairable is at the sole discretion of GTA. (4) Replacement Device shall be the same brand and model or other suitable Device of equal value.
