Incidents of HIB in schools may also implicate the New Jersey Law Against Discrimination if a school district’s failure to reasonably address HIB has the effect of denying to a student any of a school's accommodations, advantages, facilities or privileges based on race, creed, color, national origin, nationality, ancestry, sex, pregnancy, marital status, domestic partnership or civil union status, affectional or sexual orientation, gender identity or expression, and mental or physical disability, perceived disability, and AIDS and HIV status.
