Common use of Reporting on Utilization of Subject Inventions Clause in Contracts

Reporting on Utilization of Subject Inventions. The awardee agrees to submit on request periodic reports no more frequently than annually on the utilization of a subject invention or on efforts at obtaining such utilization that are being made by the awardee or its licensees or assignees. Such reports shall include information regarding the status of development, date of first commercial sale or use, gross royalties received by the awardee and such other data and information as NSF may reasonably specify. The awardee also agrees to provide additional reports in connection with any march-in proceeding undertaken by NSF in accordance with paragraph j. of this Patent Rights article. As required by 35 USC § 202(c)(5), NSF agrees it will not disclose such information to persons outside the Government without the permission of the awardee.
