Reports of Changed Conditions. The Commission shall notify the City of any material changes to the Commission’s operations which might materially alter the nature, quality, or volume of its wastewater at least 5 calendar days before the change takes effect. The City may require the Commission to submit additional information necessary for the City to evaluate the changed condition and may require the Commission to suspend its delivery of Leachate while the City studies the impact of the changed condition. If the City believes the changed condition will materially impact the operations of the POTW, the parties will negotiate in good faith to amend this Agreement to account for the changed condition.
