Representations and Warranties Heretofore Given. All representations and warranties heretofore given, including but not limited to the description of the Collateral, whether oral or written and whether they might be in the form of documents, instruments, materials, pro formas, business plans, financial statements, income statements, contracts, cash flow forecasts, materials and otherwise, upon which credit underwriting for the credit facility are based are true, complete, valid and correct on the date made and on the date hereof.
