REPRESENTATIONS AND WARRANTIES OF COMANCHE. Comanche represents and warrants to Spirit as set forth below. On the date hereof, Comanche delivered to Spirit schedules (the “Comanche Disclosure Schedules”) setting forth, among other things, items the disclosure of which are necessary or appropriate (a) in response to an express disclosure requirement contained in a provision hereof, (b) as an exception to one or more representations and warranties contained in this Article III or (c) as an exception to one or more covenants contained in this Agreement. Disclosure in any section of the Comanche Disclosure Schedules shall apply only to the indicated section of this Agreement, except to the extent that it is reasonably apparent on its face that such disclosure is relevant to another section of this Agreement.
