Common use of Representative of the Owner Clause in Contracts

Representative of the Owner. The Architect will be a representative of the Owner during construction and in this capacity will endeavor to: (a) guard the Owner against variances from the requirements of the Contract Documents by the Contractor, (b) require the Contractor to complete the Work within the time specified in the Construction Contract or subsequently extended by the Owner, (c) and guard the Owner against Defective Work. The Architect will advise and consult with the Owner regarding the performance and progress of the Contractor and regarding solutions to conditions or problems that may arise out of the design or construction. The Architect shall have authority to act on behalf of the Owner to the extent provided in the General Conditions of the Contract, which may only be modified in writing.
