Common use of Representatives Conduct Clause in Contracts

Representatives Conduct. As “ a single employee confronted by the (City) investigating whether certain conduct deserves discipline may be too fearful or inarticulate to relate accurately the incident being investigated, or too ignorant to raise extenuating factors,”1 any employee representative or attorney called to aid an employee during the investigative interview stage of an investigation may be permitted, at the Chief’s discretion, to properly aid the employee by asking questions of the employee which may bring about additional facts or qualifications concerning the issue at hand or provide insight or guidance to the employee and may object to questions which he/she believes are improper.2 The representative may not, however, use this authority as a means to disrupt the interview.
