Request for Appeal Hearings. The Union or the Operator must request any appeals within ten (10) days from receipt of the decision of the Manager of Operations or designee. The final appeal hearing shall be held within fifteen (15) days from the date of the request of the hearing by the Union, with the understanding that the Operator and the Union shall be given written notification of the time and place of the hearing at least eight (8) days in advance. The Operator shall have the opportunity to arrange representation and/or witnesses, who will be released from duty without loss of compensation if employed by METRO. The Operator’s representative or the Operator if not represented will be allowed to question all witnesses.
