Requests for Restrictions Clause Samples

The "Requests for Restrictions" clause allows an individual to ask a party, typically a healthcare provider or organization, to limit the use or disclosure of their personal information beyond standard practices. In practice, this means a patient can request that certain details about their medical treatment are not shared with specific people or entities, such as insurance companies or family members. The core function of this clause is to give individuals greater control over their personal data, addressing privacy concerns and helping to ensure that sensitive information is only shared according to the individual's wishes.
Requests for Restrictions. Business Associate shall comply with any requests for restrictions on certain disclosures of PHI to which Covered Entity has agreed in accordance with 45 C.F.R. §164.522 and of which Business Associate has been notified by Covered Entity.
Requests for Restrictions. If an individual submits a request for restriction or request for confidential communications as provided for in 45 CFR § 164.522 to Business Associate, then Business Associate shall report such request to Covered Entity within five business days of receipt. Business Associate shall not respond to such requests without written authorization of Covered Entity.
