Common use of Required Terms Clause in Contracts

Required Terms. (a) Any Facility Increase in respect of any Class shall be on the same terms applicable to the Class of Commitments or Loans, as applicable, to which such Facility Increase applies (other than with respect to upfront fees, arranger and similar fees). (b) Any Facility Increase in respect of any Class shall constitute Obligations and will be secured and guaranteed with the other Obligations on a pari passu basis.
