Rescinding Notice of Intent to Retire. If a teacher has a change in life circumstances due to divorce or death of a spouse, the teacher may rescind the letter of resignation. The additional sums received by the teacher as a result of this section shall be repaid by the teacher. The teacher and the superintendent shall reach a schedule for repayment by payroll deduction as a condition of the teacher’s right to rescind. The teacher may apply to the Board of Education to rescind a letter of resignation under this section, which the Board may grant in its discretion.

If a teacher has or teacher's spouse suffers a change in life circumstances due catastrophic injury or illness after giving notice of intent to divorce or death of a spouseretire, the teacher may rescind the letter of resignationretirement. The additional sums received by the teacher as a result of this section shall be repaid by the teacher. The teacher and the superintendent shall reach a schedule for repayment by payroll deduction as a condition of the teacher’s 's right to rescind. The teacher may apply to the Board of Education to rescind a letter of resignation under this sectionsection for other reasons, which the Board may grant in its discretion.
