Common use of RESCISSION FEE Clause in Contracts

RESCISSION FEE. The Borrower may elect not to borrow all or any portion of the Loan, in which event the Lender shall release the Borrower from its obligations hereunder provided the Borrower complies with such terms and conditions as the Lender may impose for such release including, without limitation, payment of any rescission fee which shall not exceed fifty (50) basis points times the amount of the Commitment being rescinded.
