Common use of Research Partially Funded by Third Parties Clause in Contracts

Research Partially Funded by Third Parties. If any patentable invention in the Intellectual Property has been funded by the federal government, this Agreement and the grant of any rights in that invention are governed by federal law set forth in 35 U.S.C. §§ 201-211 and corresponding regulations, as amended, or any successor statutes and regulations. If any Intellectual Property has been funded by a non-profit organization or state or local agency, this Agreement and the grant of rights in that Intellectual Property are subject to the terms of the applicable agreement. If any term of this Agreement fails to conform to applicable law, regulations, or agreements, the relevant term is invalid and the Parties shall modify the term.

Upon the request of Sponsor, University shall make available to Sponsor the terms of any agreements that partially fund the Project.
