Common use of Resignation by the Trustee Clause in Contracts

Resignation by the Trustee. The Trustee and any successor Trustee may at any time resign from the trusts hereby created by giving thirty (30) days’ notice to the Issuer, the Credit Provider, the Remarketing Agent, the Company, and the Owner of each Bond. Such resignation shall not take effect (i) until the appointment and acceptance of a successor Trustee or temporary Trustee and the transfer to said successor or temporary Trustee of the Credit Facility, and (ii) payment in full of all fees and expenses and other amounts payable to the Trustee pursuant hereto or to the Agreement.

Resignation by the Trustee. Such resignation shall not take effect (i) until the appointment and acceptance of a successor Trustee or temporary Trustee and the transfer to said successor or temporary Trustee of the Credit Facility, and (ii) payment in full of all fees and expenses and other amounts payable to the Trustee pursuant hereto or to the AgreementTrustee.

Resignation by the Trustee. The Trustee and any successor Trustee may at any time resign from the trusts hereby created by giving thirty at least sixty (3060) days’ ' written notice thereof to the Issuer, the Letter of Credit ProviderBank, the Remarketing Agent, Borrowers and the CompanyOriginal Purchaser of each series of Bonds then outstanding, and by giving such notice in the Owner same manner as provided for in the Bond Legislation for giving notice of each Bond. Such call for redemption, not less than forty-five (45) days before such resignation is to take effect, and such resignation shall not take effect (i) until at the appointment and acceptance of a successor Trustee by the Bondholders or temporary Trustee by the Issuer and acceptance by the transfer to said successor or temporary Trustee of the Credit Facility, and (ii) payment in full of all fees and expenses and other amounts payable to the Trustee pursuant hereto or to the Agreementsuch trusts.

Resignation by the Trustee. Such such resignation shall not take effect at the end of such thirty (i30) until day period, or upon the earlier appointment and acceptance of a successor Trustee or temporary Trustee and the transfer to said successor or temporary Trustee by the Bondholders or by the Issuer and the acceptance of the Credit Facility, and (ii) payment in full of all fees and expenses and other amounts payable to the Trustee pursuant hereto such appointment by such successor or to the Agreementtemporary Trustee. Such notice may be served personally or sent by registered or certified mail.
