Responsibilities for Behavioral Health Services. (1) DCS will refer behavioral health services for the Child based on the Child’s assessed needs. If it is in the Child’s best interest and DCS wishes the Contractor to provide the behavioral health services, DCS will separately refer those services to the Contractor, as specified in 465 IAC 2-17-25. Inclusion of behavioral health services as part of the Contractor’s responsibilities should be discussed with the DCS FCM before completion of the ICPR. The behavioral health services must be provided pursuant to a CMHC or Child Welfare Service contract with DCS or pursuant to this Contract if the applicable behavioral health service is identified in Attachment 1 and the referral is to the Contractor. Any behavioral health services provided by the Contractor shall be provided in accordance with the most current version of the DCS Service Standards applicable at the time services are rendered. The parties anticipate that Contractor’s approved array of behavioral health services may change over time as DCS’ needs shift and new needs may arise, therefore any changes to the array of behavioral health services within the Scope of the Contract (and their accompanying rates) may be accomplished by written notice from the State to the Contractor as detailed in Section 31 [Merger & Modification] herein. As applicable, DCS shall refer therapy to the CPA as part of the placement for children in therapeutic and therapeutic plus categories, unless it is in the Child’s best interest to be referred to a different behavioral health provider. If it is in the Child’s best interest to be referred to a different behavioral health provider, DCS will develop a transition plan in consultation with the CPA. Contractor must also keep case records for behavioral health services that document, in detail, what services are being performed, dates performed, and by whom. This should include a start and stop time on the case note. (2) DCS will pay behavioral health service providers for treatment as provided in 465 IAC 2- 17-25. (3) If a CMHC is providing treatment to the Child placed with the Contractor or to the Child’s family, the Contractor and CMHC will coordinate on treatment to avoid duplication of services and to ensure consistency of Treatment Plans (e.g. on clinic option services, a joint Treatment Plan is recommended to avoid audit problems).
