5.2 Section 106 Contributions and CIL Policy
5.2.1 During the Term, each Borough Council shall, subject to clause 5.3 below, establish the principle that developers provide an appropriate contribution to the delivery of the Programme through the operation of Section 106 Contributions and the CIL Funding Arrangements. The CIL Funding Arrangements shall state that CIL shall fund Proposed Schemes or Substitute Schemes within the Borough Council’s geographical boundaries, unless otherwise agreed.
5.2.2 The Borough Councils shall use their reasonable endeavours to collect Developer Contributions. Such financial contributions shall be subject to the Index of Constructions Costs, or other such index as shall be agreed between the Parties.
5.2.3 Within 3 calendar months of the receipt of any S106 Contributions, the Borough Councils shall forward such money to Kent as income to the Programme Investment Fund.
