Responsibilities of the Covered Entity. With regard to the use and/or disclosure of PHI by the Business Associate, the Covered Entity hereby agrees: To inform the Business Associate of any changes in the notice of privacy practices (“Notice”) that the Covered Entity provides to individuals pursuant to 45 CFR §164.520 that affect Business Associate’s use or disclosure of PHI, and provide to the Business Associate, upon request, a copy of the Notice currently in use. To inform the Business Associate of any changes in, or revocation of, the authorization provided to the Covered Entity by individuals pursuant to 45 CFR §164.508, to the extent relevant to the Services being provided under the Agreement. To inform the Business Associate of any opt-outs exercised by any individual from fundraising activities of the Covered Entity pursuant to 45 CFR §164.514(f), to the extent relevant to the Services being provided under the Agreement. To notify the Business Associate, in writing and in a timely manner, of any arrangements permitted or required of the Covered Entity under 45 CFR § part 160 and 164 that may impact in any manner the use and/or disclosure of PHI required by the Business Associate under this BA Agreement, including, but not limited to, agreed upon restrictions regarding the use and/or disclosure of PHI as provided for in 45 CFR §164.522.

Responsibilities of the Covered Entity. With regard to the use and/or disclosure of Protected Health Information by the Business Associate, the covered entity hereby agrees: a. Covered entity shall inform the Business Associate of any changes in the form of notice of privacy practices (“Notice”) that the covered entity provides to individuals pursuant to 45 C.F.R. § 164.520, and provide, upon request, the Business Associate a copy of the Notice currently in use. b. Covered entity shall inform the Business Associate of any changes in, or revocation of, the permission by an individual to use or disclose his or her protected health information, to the extent that such changes may affect business associate’s use and disclosure of protected health information pursuant to 45 C.F.R. § 164.508. c. Covered entity shall notify business associate of any limitations or restrictions placed upon PHI to the extent such restrictions or limitations affect the business associate’s use or disclosure of protected health information. d. Covered entity shall notify business associate of any amendments made to PHI at the request of any individual for the Business Associate to correct the PHI in accordance with the amendment. e. Covered entity shall notify the Business Associate of any opt-outs exercised by any individual from fundraising activities of the covered entity pursuant to 45 C.F.R. § 164.514(f). f. Covered entity shall notify Business Associate, in writing and in a timely manner, of any arrangements permitted or required of the covered entity under 45 C.F.R. Part 160 or 164 that may impact in any manner the use and/or disclosure, including but not limited to, restrictions on use and/or disclosure of PHI as provided for in 45 C.F.R. § 164.522 agreed to by the covered entity.

Responsibilities of the Covered Entity. With regard to the use and/or disclosure of PHI by the Business Associate, the Covered Entity hereby agrees: a. to inform the Business Associate of any changes in the form of notice of privacy practices (the “Notice”) that the Covered Entity provides to individuals pursuant to 45 C.F.R. §164.520, and provide the Business Associate a copy of the Notice currently in use. b. to inform the Business Associate of any changes in, or withdrawal of, the consent or authorization provided to the Covered Entity by individuals pursuant to 45 C.F.R. §164.506 or §164.508. c. to inform the Business Associate of any opt-outs exercised by any individual from marketing and/or fundraising activities of the Covered Entity pursuant to 45 C.F.R. § 164.514(e). x. to notify the Business Associate, in writing and in a timely manner, of any arrangements permitted or required of the Covered Entity under 45 C.F.R. part 160 and 164 that may impact in any manner the use and/or disclosure of PHI by the Business Associate under this BAC, including, but not limited to, restrictions on use and/or disclosure of PHI as provided for in 45 C.F.R. § 164.522 agreed to by the Covered Entity. e. that Business Associate may make any use and/or disclosure of PHI permitted under 45 C.F.R. § 164.512 except uses or disclosure for research are not permitted without prior approval by the Covered Entity. f. with respect to EPHI, Covered Entity acknowledges that it must provide appropriate security for EPHI, such as encryption and secure wireless communications, and absolves Business Associate of any liability for breaches of EPHI security caused by reception or transmission devices under the control of Covered Entity.

Responsibilities of the Covered Entity. The Covered Entity agrees to timely notify Business Associate, in writing, of any arrangements between the Covered Entity and the individual that is the subject of PHI that may impact in any manner the use and/or disclosure of that PHI by Business Associate under this Agreement.
Responsibilities of the Covered Entity. With regard to the use or disclosure of Protected Health Information by the Business Associate, the Covered Entity will: a. Obtain any consent or authorization that may be required by 45 CFR §§ 164.506 and 164.508, or applicable state law, prior to furnishing the Business Associate the Protected Health Information pertaining to such individual. b. Notify the Business Associate of any changes or limitations in the Covered Entity’s notice of privacy practices to the extent that such change or limitation may affect the Business Associate’s creation, receipt, maintenance, or transmission of the Protected Health Information for or on behalf of the Covered Entity. c. Not furnish Protected Health Information to the Business Associate that is subject to any arrangements permitted or required of the Covered Entity under the Privacy Regulation, Security Regulation, or HITECH Standards that may impact in any manner the use or disclosure of Protected Health Information by the Business Associate under this Agreement and the Agreement, including but not limited to restrictions on use or disclosure of Protected Health Information as provided for in 45 CFR § 164.522 and agreed to by the Covered Entity.
Responsibilities of the Covered Entity. With regard to the use or disclosure of PHI by the Manager, the Partnership hereby agrees: (a) To inform Manager of any changes in the form of Notice of Privacy Practices (the "Privacy Notice") that the Partnership provides to individuals pursuant to 45 C.F.R. Section 164.520, and provide the Manager a copy of the Privacy Notice currently in use; (b) To inform Manager of any changes in, or withdrawal of, the consent or authorization provided by the Partnership by individuals pursuant to 45 C.F.R. Section 164.506 or Section 164.508; (c) To notify Manager, in writing and in a timely manner, of any arrangements permitted or required of the Partnership under 45 C.F.R. part 160 and 164 that may impact in any manner the use and/or disclosure of PHI by the Manager under this Exhibit, including, but not limited to, restrictions on uses and/or disclosures of an individual's PHI as provided for in 45 C.F.R. Section 164.522 and agreed to by the Partnership; and (d) To allow Manager may make any use and/or disclosure of PHI permitted under 45 C.F.R. Section 164.512, except uses or disclosure for research are not permitted without prior approval by the Partnership.
