Common use of Responsibility for Environmental Contamination Clause in Contracts

Responsibility for Environmental Contamination. 38.1 Spectrotel will in no event be liable to Windstream for any costs whatsoever resulting from the presence or release of any environmental hazard that Spectrotel did not introduce to the affected work location. Windstream will indemnify, defend (at Spectrotel's request) and hold harmless Spectrotel, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard that Windstream, its contractors or agents introduce to the work locations or (ii) the presence or release of any environmental hazard for which Windstream is responsible under applicable law. 38.2 Windstream will in no event be liable to Spectrotel for any costs whatsoever resulting from the presence or release of any environmental hazard that Windstream did not introduce to the affected work location. Spectrotel will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard that Spectrotel, its contractors or agents introduce to the work locations or ii) the presence or release of any environmental hazard for which Spectrotel is responsible under applicable law.

Responsibility for Environmental Contamination. 38.1 Spectrotel 39.1 Allo Communications will in no event be liable to Windstream for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Spectrotel Allo Communications did not introduce to the affected work location. Windstream will indemnify, defend (at Spectrotel's Allo Communications’ request) and hold harmless SpectrotelAllo Communications, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel Allo Communications for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel Allo Communications will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelAllo Communications, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel Allo Communications is responsible under applicable law.

Responsibility for Environmental Contamination. 38.1 Spectrotel Birch will in no event be liable to Windstream for any costs whatsoever resulting from the presence or release of any environmental hazard that Spectrotel Birch did not introduce to the affected work location. Windstream will indemnify, defend (at Spectrotel's Xxxxx'x request) and hold harmless SpectrotelBirch, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard that Windstream, its contractors or agents introduce to the work locations or (ii) the presence or release of any environmental hazard for which Windstream is responsible under applicable law. 38.2 Windstream will in no event be liable to Spectrotel Birch for any costs whatsoever resulting from the presence or release of any environmental hazard that Windstream did not introduce to the affected work location. Spectrotel Xxxxx will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard that SpectrotelBirch, its contractors or agents introduce to the work locations or ii) the presence or release of any environmental hazard for which Spectrotel Birch is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelAlliance Connect's request) and hold harmless SpectrotelAlliance Connect, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel Alliance Connect for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel Alliance Connect will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelAlliance Connect, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel Alliance Connect is responsible under applicable law.

Responsibility for Environmental Contamination. 38.1 Spectrotel 40.1 Smoke Signal will in no event be liable to Windstream ALLTEL for any costs whatsoever resulting from the presence or release of any environmental hazard that Spectrotel Smoke Signal did not introduce to the affected work location. Windstream ALLTEL will indemnify, defend (at Spectrotel's Smoke Signal’s request) and hold harmless SpectrotelSmoke Signal, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard that WindstreamALLTEL, its contractors or agents introduce to the work locations or (ii) the presence or release of any environmental hazard for which Windstream ALLTEL is responsible under applicable law. 38.2 Windstream 40.2 ALLTEL will in no event be liable to Spectrotel Smoke Signal for any costs whatsoever resulting from the presence or release of any environmental hazard that Windstream ALLTEL did not introduce to the affected work location. Spectrotel Smoke Signal will indemnify, defend (at WindstreamALLTEL's request) and hold harmless WindstreamALLTEL, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard that SpectrotelSmoke Signal, its contractors or agents introduce to the work locations or ii) the presence or release of any environmental hazard for which Spectrotel Smoke Signal is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelSouthEast's request) and hold harmless SpectrotelSouthEast, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 32.2 Windstream will in no event be liable to Spectrotel SouthEast for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel SouthEast will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelSouthEast, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel SouthEast is responsible under applicable law.

Spectrotel SouthEast will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelSouthEast, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel SouthEast is responsible under applicable law.

Responsibility for Environmental Contamination. 38.1 Spectrotel 40.1 Phone-Link will in no event be liable to Windstream ALLTEL for any costs whatsoever resulting from the presence or release of any environmental hazard that Spectrotel Phone-Link did not introduce to the affected work location. Windstream ALLTEL will indemnify, defend (at SpectrotelPhone-Link's request) and hold harmless SpectrotelPhone-Link, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard that WindstreamALLTEL, its contractors or agents introduce to the work locations or (ii) the presence or release of any environmental hazard for which Windstream ALLTEL is responsible under applicable law. 38.2 Windstream 40.2 ALLTEL will in no event be liable to Spectrotel Phone-Link for any costs whatsoever resulting from the presence or release of any environmental hazard that Windstream ALLTEL did not introduce to the affected work location. Spectrotel Phone-Link will indemnify, defend (at WindstreamALLTEL's request) and hold harmless WindstreamALLTEL, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard that SpectrotelPhone-Link, its contractors or agents introduce to the work locations or ii) the presence or release of any environmental hazard for which Spectrotel Phone-Link is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelBroadview's request) and hold harmless SpectrotelBroadview, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel Broadview for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel Broadview will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelBroadview, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel Broadview is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelPeerless's request) and hold harmless SpectrotelPeerless, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel Peerless for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel Peerless will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelPeerless, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel Peerless is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelDialog Telecommunications's request) and hold harmless SpectrotelDialog Telecommunications, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel Dialog Telecommunications for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel Dialog Telecommunications will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelDialog Telecommunications, its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel Dialog Telecommunications is responsible under applicable law.

Windstream will indemnify, defend (at SpectrotelTWCIS (KY)'s request) and hold harmless SpectrotelTWCIS (KY), each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from (i) any environmental hazard Environmental Hazard that Windstream, its contractors or agents introduce to the work locations Work Locations or (ii) the presence or release of any environmental hazard Environmental Hazard for which Windstream is responsible under applicable law. 38.2 39.2 Windstream will in no event be liable to Spectrotel TWCIS (KY) for any costs whatsoever resulting from the presence or release of any environmental hazard Environmental Hazard that Windstream did not introduce to the affected work location. Spectrotel TWCIS (KY) will indemnify, defend (at Windstream's request) and hold harmless Windstream, each of its officers, directors and employees from and against any losses, damages, claims, demands, suits, liabilities, fines, penalties and expenses (including reasonable attorneys' fees) that arise out of or result from i) any environmental hazard Environmental Hazard that SpectrotelTWCIS (KY), its contractors or agents introduce to the work locations Work Locations or ii) the presence or release of any environmental hazard Environmental Hazard for which Spectrotel TWCIS (KY) is responsible under applicable law.
