RESPONSIBILITY FOR INJURY. The Owner agrees to ensure that the premises are properly cared for during the rental period. If during the rental period the Bay Club, or any portion thereof, shall be damaged by the act, omission, default or negligence of the Owner, or of the Owner’s agent, employee or employees, patrons, guests, or any person admitted to the Bay Club by Owner, then Owner shall pay to the Association, upon demand, such sum as shall be necessary to restore said Bay Club to its present condition immediately prior to commencement of the rental period. The Owner hereby assumes full responsibility for the character, acts and conduct of all persons admitted to the Bay Club, or any portion thereof, by Owner (or by or with the consent of any person acting on behalf of the Owner), and the Owner agrees to have on hand at all times sufficient persons to maintain order and protect persons and property.

If during the rental period the Bay Club, Club or any portion thereof, thereof shall be damaged by the act, omission, default or negligence of the Owner, Renter or of the OwnerRenter’s agentguests, representatives, employee or employees, patrons, guests, or any person admitted to the Bay Club by Ownerthe Renter, then Owner except for normal wear and tear, the Renter shall pay to the Association, upon demand, such sum as shall be necessary to restore said Bay Club to its present condition immediately prior to commencement of the rental period. The Owner Renter hereby assumes full responsibility for the character, acts and conduct of all persons admitted to the Bay Club, Club or any portion thereof, by Owner the Renter (or by or with the consent of any person acting on behalf of the OwnerRenter), and the Owner Renter agrees to have on hand at all times sufficient persons qualified staff to maintain order and protect persons and property.

If during the rental period the Bay Club, or any portion thereof, shall be damaged by the act, omission, default or negligence of the OwnerOrganization, or of the Owner’s Organization agent, employee or employees, patrons, guests, or any person admitted to the Bay Club by OwnerOrganization, then Owner Organization shall pay to the Association, upon demand, such sum as shall be necessary to restore said Bay Club to its present condition immediately prior to commencement of the rental period. The Owner Organization hereby assumes full responsibility for the character, acts and conduct of all persons admitted to the Bay Club, or any portion thereof, by Owner Organization (or by or with the consent of any person acting on behalf of the OwnerOrganization), and the Owner Organization agrees to have on hand at all times sufficient persons to maintain order and protect persons and property.
