Responsibility for Damage. Resident is solely responsible for any damage, defacement or loss arising within the assigned bedroom space. All assigned residents of an apartment are jointly and severally responsible for any damage, defacement or loss to common areas, other parts of the Property, fixtures or appliances, except for the portion of damages over $100,000 where it is finally established that Resident or one or more other residents of the apartment were solely at fault for the entire loss, in which case such person(s) will be solely responsible. Resident is fully responsible for the conduct of Resident’s guests, visitors, licensees and invitees (“Guests”), including without limitation harm to individuals or damage or defacement of any part of the Property or its fixtures or property of third parties (including other residents) by such Guests.

Responsibility for Damage. The Student is responsible for maintaining a 100% working Computer at all times. The Student shall use reasonable care to ensure that the Computer is not damaged. Students and Parents need to keep in mind the following pertaining to damage:

The resident is responsible for the condition of the room and furnishings which are assigned to him/her and shall reimburse VSU for all damage to or loss of these accommodations and furnishings. Students have access to the Inventory Report for their assigned room upon checking in and have 48 hours to accept the report or make changes. After 48 hours, the Inventory Report will be marked as accepted and complete.
B. The student is responsible for maintaining the cleanliness of his/her assigned space and shall reimburse the University for all cleaning costs in excess of normal cleaning costs if staff is required, at the University’s sole discretion, to clean the assigned space. The student is also responsible for care of the assigned space and is expected to report any repair needs to University Housing. The student shall be liable for increased repair costs due to failure to report conditions in need of repair. The student is responsible for using all University property in a safe, responsible manner and shall be responsible for damages to, and/or repair and replacement of, University property within their room/suite/apartment except for damage and loss from ordinary wear and tear. When the University determines that it is unable to assign liability for such damage, the student shall share equally with other hall/unit/suite residents the cost of cleaning, repair or replacement of any University property in common areas of the residence hall/unit/suite including, but not limited to, hallways, lounges and laundry rooms. The University, at its sole discretion, shall determine the amount of any costs for cleaning, loss or damage and shall notify the student of any such charges. Payment is due upon such notification. Failure to pay assessment will result in the forfeiture of the deposit and/or a hold on the resident’s registration, graduation, or issuance of transcript. No existing furnishings may be removed from the room.
C. In the event a student wishes to contest charges for damages or loss, the following procedure is prescribed:
1. Contact in writing the Office of Housing and Residence Life and include name, student ID number, assignment, and explanation of why the charges should be removed.
2. This decision may be appealed by submitting a request in writing to the Associate Director of Housing Operations.
3. All appeals for damage charges must be received within 30 days of the date of the xxxx to be considered.
Responsibility for Damage. If Tenant installs equipment in the Premises prior to completion of the Work hereunder, Tenant shall bear the risk of loss to such equipment other than as a result of negligence or willful misconduct by Landlord, its agent or contractors.

The Student shall use reasonable care to ensure that the device and accessories are not damaged. Refer to the Standards for Proper Care document for a description of expected care. In the event of damage or Loss/Theft of the device or accessories, it is the Student's responsibility to notify their school administrative office as soon as possible. In such cases, the Student and Parent will be billed according to the cost of replacement parts. Devices that are unable to be repaired will result in full replacement cost of the device being accessed. Devices that are lost/stolen or not returned will result in full replacement cost of the device and accessories being accessed. Other charges may be determined at the discretion of the school administration.
Responsibility for Damage. The Student is responsible for maintaining a 100% working Device at all times. The Student shall use reasonable care to ensure that the Device is not damaged. See #4:
Responsibility for Damage. Should the Contractor cause damage to the work or property of any other contractor of the Owner, including, but not limited to, delay, disruption, suspension of work and/or acceleration damages, the Contractor shall settle all claims with such other contractor if the other contractor will so settle. If such other contractor sues the Owner on account of any damage alleged to have been so sustained, the Owner shall notify the Contractor who shall defend such proceedings at the expense of the Contractor, or provide counsel of Owner’s choice for Owner at the expense of Contractor, and if any judgment or award against the Owner results, the Contractor shall pay or satisfy it and shall reimburse the Owner for all attorney’s fees and other litigation costs which the Owner has incurred.

All loss or damage in connection with any fire arising from or contributed to by the negligence or intentional act of Resident or his/her Guests will be the sole responsibility of Resident, regardless of insurance coverage or any applicable deductible.
