RESPONSIBILITY FOR SUPPLIES. Except as otherwise provided in the contract, (i) the Contractor shall be responsible for the supplies covered by this contract until they are delivered at the designated delivery point, regardless of the point of inspection; (ii) after delivery to the Government at the designated point and prior to acceptance by the Government or rejection and giving notice thereof by the Government, the Government shall be responsible for the loss or destruction of or damage to the supplies only if such loss, destruction or damage results from the negligence of officers, agents, or employees of the Government acting within the scope of their employment; and (iii) the Contractor shall bear all risks as to rejected supplies after notice of rejection, except that the Government shall be responsible for the loss, or destruction of, or damage to the supplies only if such loss, destruction or damage results from the gross negligence of officers, agents, or employees of the Government acting within the scope of their employment.
RESPONSIBILITY FOR SUPPLIES. Except as specifically otherwise provided in this purchase order, Seller shall be responsible for supplies meeting the requirements of this purchase order until final inspection and acceptance thereof by Buyer and shall bear all risks as to rejected supplies or supplies requiring correction after notice of rejection notwithstanding any prior acceptance.
RESPONSIBILITY FOR SUPPLIES. Supplier shall not reserve title or a security interest in products shipped to ACA. Except as otherwise provided in this Purchase Order, title to products purchased under this Purchase Order shall pass from Supplier to ACA, or the Government, as appropriate, at the F.O.B. point designated on the face of this Purchase Order, regardless of the place of inspection. However, regardless of the passage of title, loss or damage discovered after transfer of title determined to be the result of faulty packaging or handling by Supplier shall be Supplier's responsibility. Acceptance by ACA shall be final only after completion of inspection at ACA's plant. Supplier shall bear all risks for rejected products after notice of rejection. Nothing herein shall limit any of ACA's rights under the warranty clause of this Purchase Order.
RESPONSIBILITY FOR SUPPLIES. (a) Title to supplies furnished under this Agreement shall pass to the Government upon acceptance, regardless of when or where the Company takes physical possession, unless the Agreement specifically provides for earlier passage of title.
(b) Unless the Agreement specifically provides otherwise, risk of loss of or damage to supplies shall remain with the Seller until, and shall pass to the Company upon—
(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or
(2) Acceptance by the Company or delivery of the supplies to the Company at the destination specified in the Agreement, whichever is later, if transportation is f.o.b.
RESPONSIBILITY FOR SUPPLIES. Pursuant to Section 290.560 RSMo, Supplier/Contractor shall employ only Missouri laborers and laborers from nonrestrictive states except that other laborers may be used when Missouri laborers or laborers from nonrestrictive states are not available, or are incapable of performing the particular type of work involved, if so certified by the contractor and approved by the County. Except as otherwise provided, Supplier shall be responsible and bear all risks for loss and damage to goods until delivery at County's facilities, regardless of F.O.B. point, point of inspection or acceptance; and if the goods are rejected.
RESPONSIBILITY FOR SUPPLIES. Seller shall bear the risk of loss of, or damage to, the supplies covered by this Order, until delivered to All Point's facility (or to such other place as may be designated by this Order) and accepted by All Points, including any defective, nonconforming (form, fit or function) or rejected supplies.
RESPONSIBILITY FOR SUPPLIES. Seller shall bear the risk of loss of, or damage to, the supplies covered by this Agreement, until delivered to Buyer's plant or to such other place as may be designated on the face of the Order (“FOB Destination”) and accepted by Buyer, including any defective, non-conforming or rejected supplies.
RESPONSIBILITY FOR SUPPLIES. Title passes to Buyer and Buyer assumes risk of loss upon delivery to the carrier at the Sellers facility.

9.2 Unless the Contract specifically provides otherwise, risk of loss or damage to supplies shall remain with the Supplier until, and shall pass to LBTC upon:
9.3 The risk of loss of or damage to nonconforming supplies remains with the Supplier until correction or acceptance.
9.4 The Supplier shall not be liable for loss of or damage to supplies caused by the negligence of officers, agents, or employees of LBTC acting within the scope of their employment.
