Common use of Responsibility for Use of Software Clause in Contracts

Responsibility for Use of Software. You are responsible and liable for all uses of the Software and Services through access thereto provided by you, directly or indirectly. Specifically, and without limiting the generality of the foregoing, you are responsible and liable for all actions and failures to take required actions with respect to the Software and Services by you or by any Authorized User, whether such access or use is permitted by or in violation of this Agreement. You understand and hereby acknowledge that use of certain Software and/or Services in your Vehicle may create a danger or distraction, and you further acknowledge that neither Nissan nor its Service Providers may be liable for any violation of distracted driver law, accident, damage, death, injury, or other serious consequences associated with the use of Software or Services in connection with your Vehicle.
