Common use of Restrictions and Prohibitions on Use Clause in Contracts

Restrictions and Prohibitions on Use. Your license for access and use of the Site and any information, materials or documents (collectively defined as “Content and Materials”) therein are subject to the following restrictions and prohibitions on use: You may not (a) copy, print (except for the express limited purpose permitted by Section 4 above), republish, display, distribute, transmit, sell, rent, lease, loan or otherwise make available in any form or by any means all or any portion of the Site or any Content and Materials retrieved therefrom; (b) use the Site or any materials obtained from the Site to develop, of as a component of, any information, storage and retrieval system, database, information base, or similar resource (in any media now existing or hereafter developed), that is offered for commercial distribution of any kind, including through sale, license, lease, rental, subscription, or any other commercial distribution mechanism; (c) create compilations or derivative works of any Content and Materials from the Site; (d) use any Content and Materials from the Site in any manner that may infringe any copyright, intellectual property right, proprietary right, or property right of us or any third parties; (e) remove, change or obscure any copyright notice or other proprietary notice or terms of use contained in the Site; (f) make any portion of the Site available through any timesharing system, service bureau, the Internet or any other technology now existing or developed in the future; (g) remove, decompile, disassemble or reverse engineer any Site software or use any network monitoring or discovery software to determine the Site architecture; (h) use any automatic or manual process to harvest information from the Site; (i) use the Site for the purpose of gathering information for or transmitting (1) unsolicited commercial email; (2) email that makes use of headers, invalid or nonexistent domain names, or other means of deceptive addressing; and (3) unsolicited telephone calls or facsimile transmissions; (j) use the Site in a manner that violates any state or federal law regulating email, facsimile transmissions or telephone solicitations; and (k) export or re-export the Site or any portion thereof, or any software available on or through the Site, in violation of the export control laws or regulations of the United States.

Your license for access and use of the Site Portal and any information, materials materials, or documents (collectively defined referred to as “Content and Materials”) therein are subject to the following restrictions and prohibitions on use: You may not (a) copy, print (except for the express limited purpose purposes permitted by Section 4 3 above), republish, display, distribute, transmit, sell, rent, lease, loan loan, or otherwise make available in any form or by any means all or any portion of the Site Portal or any Content and Materials retrieved therefromfrom it; (b) use the Site Portal or any materials obtained from the Site Portal to develop, of or as a component of, any informationinformation system, storage and retrieval system, database, information base, or similar resource (in any media medium now existing or hereafter developed), that is offered for commercial distribution of any kind, including through sale, license, lease, rental, subscription, or any other commercial distribution mechanism; (c) create compilations or derivative works of any Content and Materials from the SitePortal; (d) use any Content and Materials from the Site Portal in any manner that may infringe on any copyright, intellectual property right, proprietary right, or property right of us the PHA or any third parties; (e) remove, change change, or obscure any copyright notice or other proprietary notice or terms of use contained in the SitePortal; (f) make any portion of the Site Portal available through any timesharing system, service bureau, the Internet Internet, or any other technology now existing or developed in the future; (g) remove, decompile, disassemble disassemble, or reverse engineer any Site Portal software or use any network monitoring or discovery software to determine the Site Portal architecture; (h) use any automatic or manual process to harvest information from the SitePortal; (i) use the Site Portal for the purpose of gathering information for or transmitting (1) unsolicited commercial email; , (2) email that makes use of headers, invalid or nonexistent domain names, or other means of deceptive addressing; and (3) unsolicited telephone calls or facsimile transmissions; (j) use the Site Portal in a manner that violates any state or federal law regulating email, facsimile transmissions transmissions, or telephone solicitations; and (k) export or re-export the Site Portal or any portion thereof, or any software available on or through the SitePortal, in violation of the export control laws or regulations of the United States; and (l) use the Portal or any information obtained from it in a manner that violates any state or federal privacy laws that protect personal information about HCV participants.

Your license for access and use of the Site Sites and any information, materials or documents (collectively defined as “Content and Materials”) therein are subject to the following restrictions and prohibitions on use: You may not . (a) copy, print (except for the express limited purpose permitted by Section 4 above), republish, display, distribute, transmit, sell, rent, lease, loan or otherwise make available in any form or by any means all or any portion of the Site or You may NOT provide any Content and or Materials retrieved therefrom; from the Sites to anyone outside your organization; (b) use the Site or any materials obtained from the Site to develop, of as a component of, any information, storage and retrieval system, database, information base, or similar resource (in any media now existing or hereafter developed), that is offered for commercial distribution of any kind, including through sale, license, lease, rental, subscription, or any other commercial distribution mechanism; (c) create compilations or derivative works of any Content and Materials from the Site; (d) You may NOT use any Content and Materials from the Site Sites in any manner that may infringe any copyright, intellectual property right, proprietary right, or property right of us or any third parties; , including that you may not review or attempt to review any other participating organization’s non-anonymized data; (ec) You may NOT remove, change or obscure any copyright notice or other proprietary notice or terms of use contained in the Site; Sites; (fd) You may NOT allow any person outside your organization to access the Sites using your login credentials. Distribution of login credentials to individuals not employed by your organization is strictly prohibited; (e) You may NOT make any portion of the Site Sites available through any timesharing system, service bureau, the Internet or any other technology now existing or developed in the future; ; (gf) You may NOT remove, decompile, disassemble or reverse engineer any Site software or use any network monitoring or discovery software to determine the Site architecture; ; (hg) You may NOT use any automatic or manual process to harvest information from the Site; ; (ih) You may NOT use the Site Sites for the purpose of gathering information for or transmitting (1) unsolicited commercial email; (2) email that makes use of headers, invalid or nonexistent domain names, or other means of deceptive addressing; and (3) unsolicited telephone calls or facsimile transmissions; ; (ji) You may NOT use the Site Sites in a manner that violates any state or federal law regulating email, facsimile transmissions or telephone solicitations; and and (kj) You may NOT export or re-export the Site Sites or any portion thereof, or any software available on or through the SiteSites, in violation of the export control laws or regulations of the United States. Unauthorized use of the Sites or failure to comply with any of this Agreement’s terms or conditions may result in termination of login privileges and/or give rise to claims for damages and/or criminal prosecution.
