Common use of Restructuring of the business Clause in Contracts

Restructuring of the business. Where the employer is proposing to restructure its business or part of its business as defined in section 69OI of the Employment Relations Xxx 0000, the employer shall negotiate with the person who undertakes or proposes to undertake the employers business (or part of it) or to whom the employer’s business (or part of it) is, or is to be, sold or transferred (the ‘new employer’) about whether affected employees will transfer to the new employer, and their conditions of employment. The employer shall consult with the Union in respect of these discussions.
