Results of Test. A. If the results of the initial test are positive, the Employer will submit the sample for a confirmation test using a GC/MS (Gas Chromatography/Mass Spectrometry) test or other method specified by DHHS Guidelines to verify the initial test results that will be conducted by an outside licensed laboratory capable of supplying an analysis of drug content. When a confirmation test is necessary, the Employer will ensure the proper storage and transportation of the specimen to a licensed laboratory for processing. B. After receipt of a positive confirmed test result from the testing laboratory, the Employer shall inform the employee of the positive test result, the possible consequences of such results, and the options available to the employee. C. The Employer shall provide to the employee, upon written request, a copy of the confirmation test results. D. Within ten (10) working days after receiving notice of a positive confirmed test result, the employee may submit information to the Employer explaining or contesting the test results, and why the results do not constitute a violation of the Employer's policy. E. All reports of positive test results shall be received by the JSO Chief of Human Resources and maintained in a confidential medical file.
