Retirement Plan Provisions Shall Control. In the event contributions are being made to the Account pursuant to any retirement plan or program sponsored by the Employer, to the extent any provisions of this Agreement are inconsistent with such retirement plan or program, the provisions of the Employer's retirement plan or program shall control, provided: (a) such provisions are not contrary to the rules and regulations under Section 403(b)(7) of the Code; and (b) such provisions do not impose any additional responsibilities or duties on the Custodian without its prior written consent. The Employer shall be responsible for delivering the most recent copy of any such retirement plan or program to the Custodian.
