Common use of Retirement Clause in Contracts

Retirement. If, during the Employment Period, the Executive and the Employer shall execute an agreement providing for the early retirement of the Executive from the Employer, or the Executive shall otherwise give notice that he is voluntarily choosing to retire early from the Employer, the Executive shall receive Accrued Benefits through the Termination Date; provided, that if the Executive’s employment is terminated by the Executive for Good Reason or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, the Executive shall also be entitled to receive a Termination Payment pursuant to Section 8.

Retirement. However, that if the Executive’s 's employment is terminated by the Executive for Good Reason or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, the Executive shall also be entitled to receive a Termination Payment pursuant to Section 8Payment.

If, during the Employment Period, the Executive and the Employer Company shall execute an agreement providing for the early retirement of the Executive from the EmployerCompany, or the Executive shall otherwise give notice that he is voluntarily choosing to retire early from the EmployerCompany, the Executive shall receive Accrued Benefits through the Termination Date; provided. However, that if the Executive’s 's employment is terminated by the Executive for Good Reason or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, the Executive shall also be entitled to receive a Termination Payment pursuant to Section 88.1 hereof.

If, during the Employment Period, the Executive and the Employer Company shall execute an agreement providing for the early retirement of the Executive from the EmployerCompany, or the Executive shall otherwise give notice that he the Executive is voluntarily choosing to retire early from the EmployerCompany, then the Executive shall receive Accrued Benefits through the Termination Date; provided, that if the Executive’s employment is terminated by the Executive for Good Reason or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, then the Executive shall also be entitled to receive a Termination Payment pursuant to Section 87(c).

If, during the Employment Period, the Executive and the Employer Company shall execute an agreement providing for the early retirement of the Executive from the EmployerCompany, or the Executive shall otherwise give notice that he is voluntarily choosing to retire early from the EmployerCompany, the Executive shall receive Accrued Benefits through the Termination Date; provided, that if the Executive’s 's employment is terminated by the Executive for Good Reason or a Discretionary Termination or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, the Executive shall also be entitled to receive a Termination Payment pursuant to Section 89(b) hereof.

If, during the Employment Period, the Executive and the Employer Company shall execute an agreement providing for the early retirement of the Executive from the EmployerCompany, or the Executive shall otherwise give notice that he the Executive is voluntarily choosing to retire early from the EmployerCompany, then the Executive shall receive Accrued Benefits through the Termination Date; provided, that if the Executive’s 's employment is terminated by the Executive for Good Reason or by the Company other than by reason of death, disability or Cause and the Executive also, in connection with such termination, elects voluntary early retirement, then the Executive shall also be entitled to receive a Termination Payment pursuant to Section 88(a).
