RETURN ACCEPTANCE TESTS. To the Knowledge of Midwest, the Facility will be able to satisfy the return conditions set forth in Section 5 of the Facility Lease as of the expiration of the Facility Lease Term, taking into account the modifications to the Facility required by Section 7.4 of the Facility Lease, if the Facility is maintained in accordance with Sections 7.1, 7.2, and 7.3 of the Facility Lease.
