Common use of Return of Destruction of Records Clause in Contracts

Return of Destruction of Records. To the extent required by HIPAA, upon termination of this HIPAA Agreement for any reason, BCBSRI shall, if feasible, return or destroy any of the Plan’s PHI that BCBSRI still maintains in any form, and shall retain no copies of the Plan’s PHI. If return or destruction is not feasible, BCBSRI shall inform Plan of the reason it is not feasible. In addition, BCBSRI and its Subcontractors shall continue to extend the protections of the Agreement to such information and limit further Use and Disclosure of such PHI to those purposes that make the return or destruction of such PHI infeasible.
