Common use of Return of Erroneous Payments Clause in Contracts

Return of Erroneous Payments. No payment made to City by the Mortgagee shall constitute agreement that such payment was, in fact, due under the terms of this Lease and the Mortgagee having made any payment to City pursuant to City's wrongful, improper or mistaken notice or demand shall be entitled to the return of any such payment or portion thereof provided it shall have made demand therefor not later than one (1) year after the date of its payment.
