Common use of Returned Merchandise Clause in Contracts

Returned Merchandise. Until the Bank exercises its rights to collect the accounts receivable as provided under any Security Agreement required under this Agreement, each Company may continue its present policies for returned merchandise and adjustments. Credit adjustments with respect to returned merchandise shall be made immediately upon receipt of the merchandise by the applicable Company or upon such other disposition of the merchandise by the debtor in accordance with that Company's instructions. If a credit adjustment is made with respect to any Acceptable Receivable, the amount of such adjustment shall no longer be included in the amount of such Acceptable Receivable in computing the Borrowing Base.
