The 'Returning from a Leave' clause outlines the procedures and conditions under which an employee resumes work after a period of approved absence, such as medical, parental, or personal leave. Typically, this clause specifies any required notice the employee must provide before returning, documentation that may be needed (such as a doctor's note for medical leave), and whether the employee will return to their previous position or an equivalent role. Returning from a Leave a. All benefits and rights accumulated by an administrator prior to the effective date of the leave of absence shall be resumed upon return to service except that this will not conflict with other portions of the contract.
b. Seniority and time toward career increments shall not accrue to persons on child-rearing leave.
Returning from a Leave. An employee returning from an approved leave of absence shall be returned to his/her former position with shift and days off if available, seniority permitting. If an employee does not have the seniority to return to their regular position or if the position no longer exists, the employee will displace the junior employee in the classification, seniority permitting or will be laid off and the provisions of Article 58 – Layoff and Recall of the Collective Agreement will apply.
Returning from a Leave. Any employee who has signed for a shift and is returning from a leave of absence, extended sick leave, vacation or any other authorized or recognized leave, shall assume their signed position. The returning employee must provide the Company with written notice prior to 16:00 the Wednesday prior to the calendar week they intend to return. In any case, where an employee who has not signed up pursuant to this Agreement for a medical reason, and, that employee is returning to work pursuant to the foregoing:
(i) If it is the first half of a sign-up period, there will be a re-bidding of the sign-up, in order of seniority, starting at the seniority position of the returning employee, who has not signed for a shift.
(ii) If it is the second half of a sign-up period, an employee who has not signed for a shift, will be given the shift of the highest Part-time employee.
Returning from a Leave. Upon returning to work after a leave of absence, the employee shall return to their former job classification, or, if their former job classification has become redundant, to other work which they are able to do in line with seniority.
