Revenues, Profits and Losses from Use of Premises; No Right of Offset. Tenant shall have the sole and absolute right to retain any and all revenues and profits resulting from its use of Premises and Hotel during the Term of this Lease. Further, Tenant shall bear any operating losses as it relates to its use of the Premises and Hotel during the Term of this Lease. Nothing contained herein shall give the Landlord the right to offset any Rent or other monies owed as a result of Tenant’s revenues and/or profits resulting from its use of Premises and Hotel. Further, Tenant shall not have the right to offset any obligations owed by Landlord to Tenant against any Rent or other monies owed by Tenant under the provisions of this Lease.

For purposes of this Article V, each Unvested Unit shall be treated as a Vested Unit. Notwithstanding the foregoing, the General Partner shall make such adjustments to Capital Accounts as it determines in its sole discretion to be appropriate to ensure allocations are made in accordance with a partner’s interest in the Partnership.

  • Compensation for Damages or Losses When investments by investors of either Contracting Party suffer damages or losses owing to war, armed conflict, a state of national emergency, revolt, insurrection, riot or other similar events in the territory of the other Contracting Party, they shall be accorded by the latter Contracting Party a treatment, as regards compensation or other settlement, not less favourable than that accorded to its own investors or to investors of any Third State.
