REVERSIBILITY. In addition to the GPC, it is specified that:
REVERSIBILITY. In case of termination or expiration of the Contract, at the Purchaser’s request, the Supplier shall ensure the reversibility of the Supply performed within the context of the Contract in compliance with the reversibility plan described in the Contract by in particular implementing all material, logistic and human resources. The objective is to allow the Purchaser to pursue and/orhaveathirdpartyofitschoicewhichshallpursuethe Supplyinwholeorinpart,provided that the continuity of the Supply shall be maintain within the context of the Contract without impacting their quality. This reversibility plan is drafted and proposed by the Supplier and subject to the Purchaser’s approval. The reversibility plan shall be mutually agreed by the Parties. The Supplier shall ensure the technical training and transfer of skills in order the Purchaser shall pursue the Supply. The Supplier shall support the Purchaser by obtaining necessary information, knowhow and skills in order to pursue the Supply.
REVERSIBILITY. At the Customer's request, sent by registered letter with acknowledgement of receipt at the latest on the effective date of termination or expiration of the Contract, the Service Provider shall return all the Data belonging to it in a readable standard electronic format, in an environment equivalent to that of the Service Provider, within a period of five thirty (530) working days [A validate] from the date of receipt of the request. The customer and/or the service provider retained by the customer undertakes to collaborate actively with the Service Provider to facilitate the reversibility of the Data. At the customer's request, the Service Provider may provide additional technical assistance services to the customer and/or the third party designated by the latter in the context of reversibility. The services of reversibility and reversibility assistance will be provided according to the financial conditions of the Provider in force on the date of notification. In the absence of a request for reversibility from the Customer, the Data will be completely deleted at the end of the Contract.
REVERSIBILITY. In the event of a termination of the Agreement as described in Section 4 and this Section 5 and Customer chooses to migrate to a different online service, Customer may request that Microsoft provide assistance in such transition through Microsoft’s Professional Services Organization at the then-current rates for such services.
REVERSIBILITY. Customer can retrieve from the SaaS Services its standard reporting data under XLS, CSV or TXT formats, without the involvement of Kyriba, at any time. During the Term, Customer can retrieve from the SaaS Services Customer’s data that is inputted into and/or stored via the SaaS Services (“Customer Data”) as part of the standard reporting data under XLS, CSV or TXT formats. No later than thirty (30) days following termination or expiry of the Agreement, and upon Customer’s written request, Kyriba will grant Customer limited access to the SaaS Services for the sole purpose of permitting Customer to retrieve Customer Data, provided that Customer has paid in full all good faith undisputed amounts owed to Kyriba. At the end of such 30-day period, and except as may be required by law, Kyriba may delete or otherwise render inaccessible any of Customer Data that remain in Kyriba’s “live” site and Customer acknowledges and agrees that Kyriba has no obligation to retain Customer Data. In the event Customer requests Kyriba to return Customer Data, such service will be invoiced at the price in effect at the time of the performance of this service.
REVERSIBILITY. This section applies at the end of a subscription to one or more TEHTRIS Solutions not renewed by the User and/or in the event of termination of the Agreement for any reason whatsoever except in the event of termination for fault by the User. Before the date of termination or expiration of subscriptions in case of non-renewal, as well as before proceeding with deletion operations, it is the User's sole responsibility to carry out any operation (such as backup, transfer to a third party solution, etc.) necessary for the conservation of his Data. TEHTRIS reminds the User that it is the User's responsibility to keep any Data that may be used for evidential purposes (traces of attacks, etc.). TEHTRIS undertakes, with the exception of the cases mentioned in the section "Property", to destroy at its expense all Data sent by the User. TEHTRIS undertakes to carry out the destruction within ten (10) days following the date of termination of contractual relations between the Parties. Upon completion of such destruction, TEHTRIS may, at the request of the User, provide a record of destruction.
REVERSIBILITY. The procedures to be carried out by 3DS OUTSCALE, and by the CLIENT, in the event of the termination of the Agreement, so that the CLIENT can transfer its Data, programs, applications, etc. to another service provider in accordance with the “Reversibility” article of this Services Agreement.
REVERSIBILITY. In the event of termination of the contractual relationship, whatever the cause, the Service Provider undertakes to destroy free of charge, at the first request of the Client via registered letter with acknowledgment of receipt and within 30 days to the date of receipt of this request, all data belonging to the Client. The Client will actively collaborate with the Service Provider to facilitate the recovery of the Data. The Service Provider will ensure that the Client can continue to process the Data, without interruption, directly or with the assistance of another provider. During the reversibility phase, the commitment levels of the quality charter will be reviewed
REVERSIBILITY. In accordance with the Agreement, 3DS OUTSCALE provides the CLIENT with Services in connection with the hosting of data, applications, etc. (the “CLIENT systems” as mentioned in the article “Definitions”). Reversibility consists in allowing the CLIENT to recover all the elements comprising its Systems (hereafter the “CLIENT elements” or the “Elements”) in order to transfer them to a Service Provider other than 3DS OUTSCALE. In order to do this, 3DS OUTSCALE places open APIs at the disposal of the CLIENT (or competent third parties designated by the CLIENT) as well as the related documentation, enabling it to recover and transfer the Elements back to its own systems or to a Service Provider other than 3DS OUTSCALE. For a period of one (1) month following the end of the Service Agreement, 3DS OUTSCALE shall provide the CLIENT with access rights for Reversibility purposes, as explained below. In the event of the termination of the Service Agreement, for any reason whatsoever, including at the initiative of 3DS OUTSCALE, the CLIENT shall have access to the Platform for one (1) month starting from the end date of the Service Agreement, enabling it only to recover all of its Elements. At the end of this period of one (1) month, the CLIENT shall transmit to 3DS OUTSCALE a signed “Recovery of data complete” report. Upon receipt of this report, 3DS OUTSCALE shall end the access necessary to recover the Data and shall delete all CLIENT Data without keeping any trace thereof. At the end of this period of one (1) month, if the CLIENT has not yet sent the signed “Recovery of data complete” report and after formal notice by registered letter with acknowledgment of receipt has been sent to the CLIENT demanding the signed “Recovery of data complete” report but produced no effect after fifteen (15) working days following receipt thereof, 3DS OUTSCALE may invoice the CLIENT for use of the storage space on which the Data are still present for a maximum period of thirteen (13) months. Beyond this, 3DS OUTSCALE reserves the right to delete any remaining Data. All CLIENT Data will be deleted at the latest two (2) weeks and one (1) day after the end of the Reversibility period. Furthermore, 3DS OUTSCALE may offer the CLIENT assistance with Reversibility service subject to an order being placed. REVERSIBILITY. Upon request from the Customer, VWT may provide the Customer with a quotation for reversibility of the Equipment Data (including the results of the data analysis).
